Does the name Derrick Watson ring a bell? It should. He is the infamous Hawaiian judge who exceeded his authority and blocked President Donald John Trump's temporary moratorium on travel to 6 nations at war and Iran. Not only did Obama appoint Watson, but he was friends with him, having been in the same class at Harvard Law School. Indeed, Obama was in Hawaii on the day his friend and judge issued his order.
It was a political hit job, because Obama had placed moratoriums on some of the same countries without Watson or anyone else complaining.
The Supreme Court later reversed Watson, because the law specifically allows presidents to impose such moratoriums.
Now it is Obama's vice president's turn to feel the burn. Trump-appointed judges are stopping Josef Biden from bending the law to his will.
Fox reported, "Judge Terry Doughty of the Western District of Louisiana implemented a nationwide injunction on the Biden administration's "pause" on new oil and gas leases, saying that the president does not have the authority to overrule laws requiring the administration to sell those leases."
Doughty's order said, "Although there is certainly nothing wrong with performing a comprehensive review, there is a problem in ignoring acts of Congress while the review is being completed."
Then there was Judge Amal Thapar's stopping of a racist and sexist program to delay and deny covid 19 relief to white men.
Writing for a majority of three appellate judges, Thapar said, "This case is about whether the government can allocate limited coronavirus relief funds based on the race and sex of the applicants. We hold that it cannot. Because these race-neutral alternatives exist, the government’s use of race is unconstitutional. Aside from the existence of race-neutral alternatives, the government’s use of racial preferences is both overbroad and underinclusive."
Fox also reported, "Judge Dabney Fredrich ruled last month that the Centers for Disease Control and Prevention's moratorium on evictions was unlawful and vacated it, although she did stay her own ruling to give the government time to appeal."
Ilya Shapiro of Cato told Fox, "What you’re seeing is that ‘pen and phone’ initiatives are running into legal trouble right off the bat.
"Trump appointed a lot of judges — more than anyone in one term other than Jimmy Carter, for whom Congress created 152 new judgeships to fill — and these folks aren’t as deferential to executive power as past Republican-appointed judges might have been."
Shapiro left out the part where Trump was a rare Republican president to serve with a Republican Senate. Nixon and the Bushes had to cut deals with Democrat senators to get their judges confirmed. Bush 41 had to appoint David Souter to get Clarence Thomas confirmed later.
Trump is paying Obama back. He was able to appoint so many conservative judges for three big reasons.
1. Republicans controlled the Senate, which made confirmation almost automatic.
2. Trump did not appoint cronies. He relied strictly on recommendations from the Heritage Foundation.
3. There are more Trump judges because Mitch McConnell refused to confirm any Obama judges for 2 years.
Trump's judges are paying back Obama and Democrats for their obstruction of President Trump. And because Republicans refused to confirm more Obama judges, about half those Trump judges should have been Obama judges.
